JUSTICE RAKESH KUMAR ORAL ORDER 15-10-2015 Heard Smt. Bela Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner, apprehending his arrest in connection with Kurhani P.S. Case no.194/15, registered for the offence under Section 379 of the Indian Penal Code, has prayed for grant of anticipatory bail.
Learned counsel for the petitioner submits that F.I.R. was lodged against unknown but subsequently in course of investigation, his name has figured. However, on perusal of the impugned order, it is evident that the stolen Sisham tree was recovered from the saw-mill of the petitioner. Accordingly, it is not a fit case for extending the privilege of anticipatory bail. The petition stands dismissed.
