Sinha learned senior counsel duly assisted by Mr. Vijay Anand learned counsel for the Economic Offence Unit.

2. The petitioner seeks bail in a case registered for the offence punishable under Sections 420, 406/34, 467, 468 and 471 of the IPC and Section 3 of the B.P.I.D. Act.

3. The allegation in the first information report is that money of the depositors was defalcated from a company and the petitioner also had complicity as he was working as a cashier in the said company.

Learned counsel for the petitioner submits that from a bare perusal of the First Information Report, it would be evident that the petitioner was merely a cashier in the company, working on a salary basis, and was neither a member of the Board nor a Director. It is further submitted that the Board members, who are co-accused in this case, have already been granted bail and from the order dated 18.04.2025 passed in Cr. Misc. No. 71875 of 2022 and other analogous cases, it appears that the provisional bail granted to Ajay Kumar and Prabhash Kumar Thakur has been confirmed in view of the order of the Hon'ble Supreme Court. Learned counsel further submits that the case of the petitioner stands on a better footing and as a matter of fact, he has also invested his own sum of Rs. 50,000/- in the said company, which is evident from Annexure-P/2. The petitioner is in custody since 11.01.2025 and has no criminal antecedent.

5. Learned Senior Counsel appearing on behalf of the Economic Offences Unit, however, opposes the prayer for bail on the ground of the allegations made in the First Information Report as well as the materials that have surfaced during the course of investigation.

6. Taking into consideration the facts and

No.59842 of 2025(4) dt.12-12-2025 3/3 circumstances and also considering the fact that the petitioner is in custody since 11.01.2025 with no criminal antecedent and charge sheet already having been submitted coupled with the fact that other co-accused persons who were the Board members have already been granted bail by a coordinate bench of this Court, let the above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Town Kotwali (O.P) P.S Case No. 244 of 2020.
