This application for anticipatory bail arises out of Indian Forest Case No. 45 of 2019, disclosing offences under Sections 33,41,42 of the Indian Forest Act and Sections 2, 17, 27, 29, 31 and 51 of the Wild Life Protection Act. Co-accused Ramraj Mallah was apprehended by the forest officials with five bundles of cane, cut from the forest area. He is said to have disclosed the names of these petitioners also, who were involved.
Learned counsel for the petitioners has submitted that over and above the said disclosure made by the said co-accused,
Patna High Court CR. MISC. No.52458 of 2019(2) dt.22-08-2019 2/2 there is no material against these petitioners. Considering the submission advanced on behalf of the petitioners, this application is allowed. Let the petitioners, above named, in the event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned ACJM 1st, Bagaha, West Champaran in connection with I. F. No. 45 of 2019, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
