The Petitioner is apprehending his arrest in a case registered for the offences punishable u/s 363, 366(A) of the Indian Penal Code.
As per the prosecution case, the petitioner and the coaccused person are alleged to have kidnapped the minor daughter of the informant for illegal purposes. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. Learned counsel further submitted that the petitioner and the victim girl are living together and leading happy conjugal life. It is further

No.60645 of 2022(4) dt.08-02-2023 2/2 submitted that as per impugned order dated 13.07.2022 the victim girl went to the petitioner and married him in Thawe temple with her own sweet will. There is nothing against the petitioner to show that the petitioner kidnapped the minor girl forcibly to have illicit intercourse with other person. The petitioner has no criminal antecedent as stated in para 3 of the bail petition.
Learned A.P.P. for the State has vehemently opposed the anticipatory bail petition of the petitioner. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Gopalganj in connection with Gopalganj Town P.S. Case No. 400 of 2019, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
The application stands allowed.
