2. The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 324, 307, 379, 504, 506 and 34 of the Indian Penal Code.

3. As per prosecution case, this petitioner is alleged to have assaulted on head of informant by means of spade. Doctor has found the injuries sustained by the injured to be grievous in nature.

4. It is submitted by learned counsel for the petitioner that there is no accusation of repetition of assault. Petitioner has falsely been implicated in this case due to land dispute. Petitioner is in custody since 18.04.2024. Petitioner has got one criminal antecedent in which he is already on bail.

5. Learned A.P.P. for the State has vehemently

Patna High Court CR. MISC. No.58917 of 2024(2) dt.06-09-2024 2/2 opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case, nature of accusation and period of custody, the prayer for grant bail of to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Birpur, Supaul, in connection with Raghopur P.S. Case No. 148 of 2023.
