Mr.Ajit Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 20-06-2025 Heard learned counsel for the petitioner and learned APP for the State Shri Jharkhandi Upadhyay, who has filed counter affidavit in this case.

2. This is the second attempt of the petitioner in connection with Sessions Trial No. 338 of 2024 arising out of Samastipur (Muffasil) P.S. Case No. 227 of 2020 registered for the offence under Sections 302, 201, 120-B of the Indian Penal Code.

3. As per the prosecution case, the petitioner is accused of killing the deceased.

4. It has been submitted by the learned senior counsel for the petitioner that the petitioner is in custody since

Patna High Court CR. MISC. No.57949 of 2024(6) dt.20-06-2025 2/2 12.07.2023 and no witnesses has been examined after the framing of charge.

5. In these circumstances, considering the period of custody and the delay in the trial, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Samastipur/concerned Court below in connection with Sessions Trial No. 338 of 2024 arising out of Samastipur (Muffasil) P.S. Case No. 227 of 2020.

7. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
