This appeal has been filed for grant of bail in connection with SC/ST case No. 414 of 2017, arising out of Sandesh P.S. Case No. 55 of 2017 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 504, 506 of the Indian Penal Code and 3(i)(r)(s), 3(ii) of SC/ST Act and for setting aside the order dated 12.7.2017.

Allegation against the appellant is of assaulting the informant by sharp cutting weapon causing grievous injury to him. Submission of learned counsel for the appellant is that allegation of assault is against two persons, including the appellant and appellant is in custody for eight months.

Patna High Court CR. APP (SJ) No.2547 of 2017 (3) dt.20-09-2017 2/2 Learned Special P.P. has opposed the prayer for bail stating that injury is grievous and, that too, on head of the informant.

Having heard both sides and in view of facts and circumstances, I am not inclined to grant bail to the appellant at this stage.

However, learned trial court is directed to expedite the trial and try to conclude it within six months. If trial is not concluded within the said period, the court below will release the appellant on bail to its own satisfaction.
