The petitioner has filed the instant application for grant of regular bail in connection with Mushrigharari P.S. Case No. 129 of 2020 registered under sections 302 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act. According to prosecution case, the informant along with her son went to see their agricultural field. She further stated that after her son went to the shop of barber, in the meantime, co-accused persons along with this petitioner came on two motorcycles and made indiscriminate firing on her son, after that he was taken to hospital but he died. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has

It is further submitted that there is no specific allegation has been levelled against the petitioner. He has no concern with the alleged offence. Similarly situated other co-accused person namely, Sonelal Singh has already been granted bail by the different co-ordinate Bench of this Court vide order dated 07.12.2021 in Cr. Misc. No. 22452 of 2021 which is annexed as Annexure-3 of this petition. The petitioner is languishing in judicial custody since 27.06.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Mushrigharari P.S. Case No. 129 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate- 1st Class, Samastipur.
