In the present writ petition, petitioner is challenging the action of respondents in refusing to appoint him and to declare him successful for the post of constable in Bihar Police against Advertisement No.1 of 2012.

Petitioner has applied for post of constable against advertisement no.1 of 2012. After clearing written test she appeared before the physical verification and there she was found that she is below 155 cm which is minimum requirement

Patna High Court CWJC No.12358 of 2013 dt.22-11-2016 of height for female candidate. She filed an appeal before the Chairman, Central Selection Board of Constable, the she was again put to re-measurement and her height was found to be 153.8 cm.

Admittedly petitioner is short of height of 155 cm, which is clear from representation of the petitioner dated 3.5.2013 (Annexure-6) where she herself requested to grant relaxation by 1 cm which indicates that she was knowing her height is less than 155 cm and for selection of constable minimum requirement of height is 155 cm. Once height has been measured and it was re-measured and her clear statement itself shows that she is below in height.
