JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody since 27.3.2017 in connection with Chapra Rail P.S. Case No. 13 of 2017 for the offence under sections 401/34 of the Indian Penal Code. From the FIR, it appears that petitioner was one of the members of the miscreants assembled at the railway station at platform no. 3 of Chapra junction as disclosed by Deepak Prasad that they were allegedly preparing for commission of offence. One Deo Narayan Prasad whose name was also disclosed by co-accused Deepak Prasad was granted anticipatory bail in Cr. Misc. No. 22948 of 2017 vide order dated 7.6.2017 by this Hon'ble Court. The case of the petitioner is similar to that of co-accused Deo Narayan Prasad who has been granted anticipatory bail and as such on the ground of parity, I am inclined

No.27385 of 2017 (2) dt.06-07-2017 2/2 to enlarge the petitioner named above on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate (Railway), Sonepur, Saran at Chapra or the successor court in connection with Chapra Rail P.S. Case No. 13 of 2017 on the condition that the petitioner will extend full cooperation in the trial and will not, in any manner, tamper with the evidence or influence the witnesses.
