06-07-2017 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor.

Informant, a inspector of 20th Battalion of SSB found few persons having bag over their head coming inside Indian territory from Nepal who, seeing them threw the bag and ran towards Nepal out of whom two were apprehended who are the petitioners. Furthermore, the aforesaid bags were searched out wherefrom 843 bottle each containing 300 ml of Nepal origin wine were found. Petitioners are under custody since 12.04.2017 having no criminal antecedent being of tender age as is evident from the forwarding report.

Patna High Court Cr.Misc. No.28587 of 2017 (2) dt.06-07-2017 Accordingly, petitioners Vivek Kumar Yadav @ Vivek Kumar Yadava, Raj Ballabh Kumar Ram each are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with C2-225 of 2017.
