Petitioners apprehend their arrest in connection with Nasariganj (Rajpur) P.S.Case No. 260 of 2017 registered for the offences punishable under Sections 304/34 of the Indian Penal Code.

Allegation against the petitioners is that due to their negligence brother of informant, who was working in 11000 KV line, received electric shock and died.

Submission of learned counsel for the petitioners is that

Patna High Court Cr.Misc. No.40240 of 2018 (2) dt.11-07-2018 2/2 petitioners Nos. 1, 3, 4 and 5 are employees of Shirdi Sai Private Limited Company, Hyderabad, and petitioner No.2 is lineman and there is nothing specific against them except that due to their negligence occurrence took place.

Having heard both sides and in the facts and circumstances, let the petitioners, named above, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Sri Lal Bihari Paswan, Judicial Magistrate, 1st Class, Bikramganj (Rohtas), in connection with Nasariganj (Rajpur) P.S.Case No. 260 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
