The petitioners are apprehending their arrest in connection with Ara, Nawada P.S. Case No. 295 of 2015 for the offences instituted under Sections 420, 468, 471, 441, 323, 379 and 504 of the IPC.

As per the prosecution case that the informant alleged in his complaint petition that he is an agnate of Arjun Mahto and also alleged that land measuring 11 decimal pertaining to Khata no.173, plot no.135 and 274 in his exclusive share and the same was in possession since long back and his co-sharer Arjun Mahto sold the land of his share to Mithilesh Pandey and have

Patna High Court Cr.Misc. No.57781 of 2015 (2) dt.09-03-2016 participated in transaction of land and they have committed the offence of cheating and further alleged that on protest the accused persons have assaulted the informant.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. Petitioners had purchased the property in question from the nephew of the informant and for the said reason, the present prosecution has been brought against the petitioners. The matter relates to a civil dispute.

On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Ara Nawada P.S. Case No. 295 of 2015 on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Bhojpur at Ara, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
