The petitioner apprehends his arrest in Complaint Case No.2879/2012, Tr. No.325 of 2018 registered under Section 420 of the Indian Penal Code.
The gist of the allegation is that the petitioner fraudulently made interpolation in the records of right and petitioner got compensation of .016 Hectare of land instead of 0.024 Hectare of land.
Learned counsel for the petitioner submits that the petitioner has already deposited excess amount of compensation received by him but it appears that the prayer for anticipatory bail
Patna High Court Cr.Misc. No.39523 of 2018 (2) dt.09-07-2018 2/2 of the petitioner was earlier rejected vide order dated 18.09.2014 passed in A.B.P. No.192 of 2014 but even thereafter the petitioner neither moved before this court nor surrendered in the court below. The petitioner again filed anticipatory bail petition in the court below after four years of his earlier prayer for anticipatory bail was rejected.
Taking into consideration the aforesaid facts, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected in connection with Complaint Case No.2879/2012, Tr. No.325 of 2018, pending in the court of learned A.C.J.M.-V, Saran at Chapra.
