The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 195, 195(A), 196, 197, 198, 420, 465, 467, 468, 469 of the Indian Penal Code.
Allegation against the petitioner is that he had produced a fabricated document before Kudra Primary Helath center to attain a false injury in connection with Kudra P.s. case No. 110 of 2021 showing the nature of injury received by him is grievious in nature in relation to other accused Chitranjan Chaubey. It is further alleged that the Hospital of which the fabricated document was produced, was not in existence on the relevant date.

He has falsely been implicated in this case. It is further submitted vide para 6 & 7 of the petition that there is case and counter case of Kudra P.S. Case No. 110 of 2021 by one of the accused and Kudra P.S. Case No. 111 of 2021 by opposite party and I.O. of the both cases was become biased and favoured opposite party thereafter on complaint by petitioners party, he was removed from further investigation but the new deputed I.O was also convinced by earlier I.O and in relation this new case has been lodged against the petitioner. It is true that injury report was submitted by petitioner and injured petitioner had got treatment at said hospital during Covid-19 period and he has no concern with the investigation and injury report submitted by Police. It is further submitted that the petitioner is languishing in judicial custody since 17.8.2022.
Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with
Patna High Court CR. MISC. No.56068 of 2022(2) dt.19-01-2023 3/3 Kudra P.S. Case No. 40 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VI, Bhabua (Kaimur).
