The sole petitioner, who is in custody since 14.04.2017 in Korha P.S. Case No. 108 of 2017 registered for the offence under Section 272, 273 of the Indian Penal Code, 1860 and Section 30(a) of the Bihar Prohibition And Excise Act, 2016 has prayed for grant of bail primarily on the ground of parity. He submits that from a vehicle four accused persons were arrested and out of four , three co- accused namely Tuntun Mandal , Lavkush Mandal and Rakesh Kumar Mandal have already been granted bail on 07.07.2017 vide Cr. Misc. No. 30559 of 2017 ( Annexure - 2 to the present petition). Considering the fact that co -accused in similar circumstances have already been granted bail, there is no reason to deny the

Patna High Court Cr.Misc. No.43186 of 2017(2) dt.19-09-2017 2/2 prayer for bail to the petitioner. .

Let the petitioner Md. Tetar be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned A.D.J. - II - cum - Special Judge, Excise Act, Katihar / concerned court in connection with Korha P.S. Case No. 108 of 2017 .
