2. Learned counsel for the petitioner submits that the present writ petition has been filed by the petitioner for pensionary benefits and to make payment of the withheld salary of the petitioner and also to pass final order in the departmental proceeding and further to direct the respondents to sanction full pension.

3. Learned counsel for the petitioner further submits that he has filed representation before the Addl. Chief Secretary, Govt. of Bihar, vide Annexure-12, but till date no decision has been taken.

4. Learned counsel for the State submits that the departmental proceeding is pending against the petitioner and final decision yet to be taken.

5. In the light of the submission made, the Addl. Chief Secretary, Health Department, Govt. of Bihar, is directed to take decision within 90 days from the date of receipt/ production of a copy of this order, on the representation filed by the petitioner dated 22.05.2024

6. With the aforesaid direction, this writ petition is disposed of.
