JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-02-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Halsi P.S. Case No. 117 of 2012 registered for the offence under Sections-304(B)/34 of the Indian Penal Code. The petitioner happens to be husband of the deceased.

No doubt, after full-fledged trial, the father of the petitioner has already been acquitted by learned Additional Sessions Judge, Lakhisarai in Sessions Trial No. 334 of 2013 but taking note of this fact that the present case was registered in the year, 2012 and the petitioner did not surrender before the court below, I am not inclined to grant privilege of anticipatory bail to

Patna High Court Cr.Misc. No.34094 of 2014 (2) dt.12-02-2015 2/2 the petitioner and accordingly, prayer for anticipatory bail of the petitioner in connection with Halsi P.S. Case No. 117 of 2012 pending in the court of Sri Om Shankar, J.M. Ist Class, Lakhisarai/concerned court stands rejected.

However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
