JUSTICE SANJAY PRIYA ORAL ORDER 07-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Muzaffarpur Town P.S. Case No. 815 of 2016 instituted for the offence under Sections 414 and 401/34 of the Indian Penal Code.
It is alleged that one stolen lady purse was recovered from possession of petitioner which contained several gold jeweleries and other articles as mentioned in the seizure list. Those articles were said to be stolen articles and after recovery of the same, the police has registered Muzaffarpur Rail P.S. Case No. 110 of 2016 for the offence under Section 379 of the Indian Penal Code against the petitioner. The petitioner had confessed before the police that those articles were stolen articles.
Patna High Court Cr.Misc. No.37362 of 2017 (2) dt.07-08-2017 2/2 The Sessions Judge has mentioned in the impugned order that during investigation it has come in paragraphs-29 and 44 of case diary that Kesh Bahadur Thapa came in court and stolen articles were released in his favour.
Therefore, this Court is not inclined to grant bail to the petitioner at this stage.
Prayer for bail of the petitioner stands rejected. Petitioner may renew his prayer for bail after six months if no substantive progress is made in the Trial in the court below.
