This application, for grant of anticipatory bail, arises out of Maniyari Police Station Case No. 72 of 2013, disclosing offences under Sections 392/34 of the Indian Penal Code. Allegation as per F.I.R. is that the truck of the informant was looted by some miscreants and the articles kept in the said truck was recovered from the godown of the PACS and it is alleged that the petitioner is the Chairman of the said PACS. Submission of learned counsel for the petitioner that he has falsely been made accused in this case and godown in charge is the Manager and not the petitioner and he is nowhere involved in the offence.
Patna High Court Cr.Misc. No.41108 of 2018 (2) dt.17-07-2018 2/2 Considering the facts and circumstances of the case and the nature of accusation, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather he should surrender before the court below and pray for regular bail, which will be decided by the court below on the merit of the case.
