The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 304(B) and 34 of the Indian Penal Code. The brother of the deceased made allegation that husband of his sister and her in-laws including the petitioner burnt his sister to death.
Learned counsel for the petitioner submits that the petitioner is mother-in-law of the deceased.
It appears that the petitioner has already been declared absconder and chargesheet is submitted. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected. However, the petitioner, if so advised, may surrender
Patna High Court Cr.Misc. No.34674 of 2014 (6) dt.26-11-2015 2/2 before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail, her prayer shall be considered on its own merit without being prejudiced by this order, taking into consideration that the husband of the petitioner has already been granted regular bail and dispose of the bail petition preferably on the same day, if possible.
