JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-08-2019 Petitioner seeks bail in anticipation of her arrest in connection with Excise Case No. 325 c-2 of 2018 registered for the offences punishable under Sections 30(a) and 37(b) of Bihar Prohibition and Excise Act.

Allegation is of recovery of 8 litres of liquor from the place of site of accused petitioner.

Submission of learned counsel for the petitioner is that nothing has been recovered from his conscious possession and he has falsely been implicated having no criminal antecedent.

Heard learned APP, who has opposed the prayer for anticipatory bail on the ground that prosecution report disclosed recovery of liquor from the place of site of accused petitioner

Patna High Court CR. MISC. No.52655 of 2019(2) dt.23-08-2019 2/2 and he is engaged in liquor trade, as such this application is not maintainable.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day. With the above observation, this application is dismissed.
