The petitioner apprehends arrest in a case registered for the offence punishable under sections 302/120B/34 and other ancillary sections of the Indian Penal Code. Learned counsel for the petitioner submits that the informant claims himself to be eye witness of the case and has named three persons in the FIR indulged in committing murder of his son but has not named the petitioner. Petitioner's name has figured during course of investigation in confessional statement of co-accused. No other substantive evidence has been collected during course of investigation to suggest the implication of this petitioner in the present case. Petitioner has

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, West Champaran, Bettiah in Chanpatiya Police Station Case No. 283 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
