The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 384, 386 of the Indian Penal Code.
The prosecution case is that on 24.09.2015 informant while coming home was surrounded by the accused persons, rupees three lakh as extortion was demanded, when co-accused Anil Kumar wrapped towel on the neck of the informant. In order to save his life the informant handed over the bag containing ornaments to Anil Kumar and this petitioner also snatched Rs. 8,000/- from the informant, when co-accused Hari Nath Sharma snatched motorcycle of the informant.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.9122 of 2016 (2) dt.29-02-2016 petitioner that the petitioner is agnate of the informant. The accusation has been levelled in the background of pending Title Suit No. 240 of 2015 filed by co-accused Hari Narayan Singh and Others against the informant's side. Prior to filing of the present case, Complaint Case No. 1670 of 2015 filed by coaccused Hari Narayan Singh against Nadish Naman and informant of this case. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the delayed lodging of the case, the accusation being levelled in the background of pending Title Suit and the case lodged by the petitioner's side at earlier point of time, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sri Santosh Kumar, J.M., Ist Class, Begusarai in connection with Bhagwanpur (Tiyai) P.S. Case No. 161 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
