1. While rejecting the application for bail of the petitioner vide order dated 23.2.2024 passed in Cr. Misc. no.8683 of 2024 the following directions was given: "9. The Senior Superintendent of Police, Muzaffarpur shall ensure the appearance of the Investigating Officer of the case on the next date in the learned trial Court.
10. Let a copy of this order be communicated to the Senior Superintendent of Police, Muzaffarpur for its due compliance through the Investigating Officer concerned."
2. A report was called for in the instant case. As per the report received contained in letter dated 19.9.2024 of the Special Judge, Exclusive Special Court I (NDPS), Muzaffarpur it is stated that the Investigating Officer, Umakant Singh, S.I. of Maniyari P.S., District Muzaffarpur, still remained to be examined. It is further stated in the report that the said
Patna High Court CR. MISC. No.61520 of 2024(3) dt.28-10-2024 2/2 Investigating Officer is posted at CID, Patna.
3. Call for a report from the Senior Superintendent of Police, Muzaffarpur with respect to the appearance/examination of the Investigating Officer concerned.
4. In addition to the above, learned APP for the State will also take instructions with respect to the Investigating Officer who is said to be at present posted at CID, Patna and suffering from Kidney disease.
5. An affidavit shall be filed stating about the time within which he will appear in the trial and the time within which the examination of the prosecution witnesses is expected to conclude.
6. Put up this case on 22.11.2024.
