This application has been filed for restoration of CWJC No. 4299 of 2017, which was dismissed as withdrawn, on a prayer being made by learned Counsel for the petitioner. Learned Counsel for the petitioner submits that on 04.07.2019, before pre-sitting Bench of Lok Adalat, several writ applications were withdrawn by him and inadvertently the present writ application was also withdrawn inasmuch as the

Patna High Court MJC No.3112 of 2019(2) dt.04-09-2019 2/2 prayer made by the petitioner in the present writ application still subsists and has not become infructuous. He, accordingly, submits that the order, dated 04.07.2019, may be recalled and this application be allowed and the connected case, being CWJC No. 4299 of 2017 be heard on its own merits.

After hearing learned Counsel for the parties, this application is allowed and the order, dated 04.07.2019, is hereby recalled and CWJC No. 4299 of 2017 is restored to its original file.
