2. The present writ application has been filed for the following reliefs:

(i) For a direction upon the respondents to include the name of the petitioner in the merit list on the basis of the form for appointment of Talimi Markaz (Shikhsa Sewak) submitted by the petitioner before Markaz Incharge, within time along with all relevant documents.

2/4 (ii) For directing the respondents to complete the selection process in the light of the letter no.13/Vi.03-01/2016-327 dated 11.04.2025 issued by the Additional Chief Secretary, Education Department, Bihar, Patna addressed to all the District Officer of Bihar by appointing the Talimi Markaz (Shiksha Sewak).

(iii) For any other relief(s) for which the petitioner is found entitled to in the facts and circumstances of the case.

At the outset, learned counsel for the petitioner submits that the State Government had decided to appoint Talimi Markaz (Shiksha Sewak) against the vacant post in the District under Mahadalit, Dalit Avam Minorities Extreme Backward Class, Akshar Anchal Yojana and in this regard, the District Education Officer, Aurangabad had published the work calendar on 05.03.2024 for appointment of Talimi Markaz (Shiksha Sewak). Further, the Additional Chief Secretary, Education Department, Bihar, Patna has issued letter no.13/Vi.03-01/2016-327 dated 11.04.2025 addressed to all District Magistrate of Bihar fixing the date for completion of appointments. Where survey work was completed, the last date was fixed as 15 June, 2025 and where the survey work was not completed, the date was fixed for 30.06.2025.

4. It is the case of the petitioner that the survey was completed in his block, as such the completion of appointment of the post was required to have been done by 15.06.2025. It is the case of the petitioner that despite application form, as appended with this writ application as Annexure-P/3, filled up for submitting the same for evaluation, the same was not accepted by the Incharge, namely, Urmila Devi, who was authorized to receive such application. The petitioner had to ultimately submitted the said application before the person who was authorized to receive such application in the office of the Block District Officer, Goh, Aurangabad. It has been submitted that it is on account of non-receipt of the application, the name of the petitioner was not found on the merit list.

It is further submitted that the application form, which the authorities were supposed to receive was not received for reasons unexplained. The petitioner, who is said to have submitted the same before the person who was authorized to receive it in the office of Block District Officer, Goh, Aurangabad contends that it was obligatory on them to consider the case of this petitioner for appointment on the post of Talimi Markaz (Shiksha Sewak).

5. In this background, this Court finds it fit and proper instead keeping the instant writ application pending and asking the respondent to file counter affidavit, let this matter be

4/4 considered by the Block Development Officer, Goh, Aurangabad, or in case, if he does not find himself competent to pass an order then the said application could be placed before the competent authority with a note that he should decide the same within a period of three weeks from the date of receipt/production of a copy of this order.
