JUSTICE RAVI RANJAN ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in a case registered for offences punishable under Sections 272, 273 of the I.P.C. and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. As per allegation, 14 liters 400 ml. Nepali English Wine have been recovered from the possession of the petitioner. Petitioner claims his antecedent to be clean and he is in custody since 11.03.2017.

Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of A.D.J.II-

Patna High Court Cr.Misc. No.32216 of 2017 (2) dt.13-07-2017 2 / 2 cum-Special Judge, Excise Act, Sitamarhi in connection with Sonbarsa P.S. Case No.53/2017.

Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bond.
