This application for anticipatory bail arises out of Beur P.S. Case No. 125 of 2019, disclosing offences under Sections 467, 468 and 420/34 of the Indian Penal Code. There is allegation in the FIR that the informant had entered into some agreement for purchase of a piece of land, whereafter a sale deed was executed by one Dasrath Rai, who was the owner of the said land. Subsequently, the informant learnt that it was an accused Ravindra Singh, who had impersonated himself as the said Dasrath Rai and had put his signature on the sale deed at the time of registration as Dasrath Rai.

Learned counsel, appearing on behalf of the

Patna High Court CR. MISC. No.51746 of 2019(2) dt.20-08-2019 2/2 petitioner, has submitted that there is nothing specific against this petitioner and only on the ground that he was also a party to the transaction, his name has been mentioned in the FIR. On perusal of the FIR, I find substance in the submission made on behalf of the petitioner.

This application is accordingly allowed. Let the petitioner, above named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of the learned ACJM, Patna in Beur P.S. Case No. 125 of 2019, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
