JUSTICE SANJAY PRIYA ORAL ORDER 01-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Ahiyapur P.S. Case No. 103 of 2017 instituted for the offence under Sections-401 of the Indian Penal Code and 25(1-b)a, 26 and 35 of the Arms Act. It has been submitted that there is no signature of this petitioner on the seizure list. It has further been submitted that petitioner is in custody since 18-02-2017.
It is alleged in the written report that one loaded country-made pistol along with one pillet have been recovered from possession of the petitioner. The seizure list has been enclosed with the FIR which does not bear signature of the petitioner.
Keeping in view the period spent by the petitioner
Patna High Court Cr.Misc. No.31229 of 2017 (3) dt.01-08-2017 in custody and the fact that the seizure list does not bear signature of the petitioner, let the petitioner named above be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Ahiyapur P.S. Case No. 103 of 2017 to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur subject to condition that both the bailors should be close relative of the petitioner.
