JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-02-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in registered for the offences punishable under section 392 of the Indian Penal Code. As per the prosecution case, three unknown miscreants looted cash, mobile phone and motorcycle of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is in custody since 1.8.2021. Test Identification Parade has not been carried out till date.

Learned counsel for the State opposes the prayer for bail and submits that the petitioner's name has come in the case on the basis of the confessional statement of co-accused and looted motorcycle of the informant has been recovered from the

Patna High Court CR. MISC. No.65759 of 2021(2) dt.24-02-2022 2/2 possession of the petitioner.

Considering the fact and circumstances of the case as well as the fact that looted motorcycle of the informant has been recovered from the possession of this petitioner, his his prayer for bail is refused.
