The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 120(B), 420, 467, 468 of the Indian Penal Code and Sections 13(3) r/w 13(1)(d) of the Prevention of Corruption Act. As per prosecution case, during the period of demonetization, 41 fake Bank accounts were opened in three Branches of Bihar Awami Co-operative Bank Limited, on the basis of identity proof, address proof and other requirements arranged by cheating innocent persons. The petitioner is alleged to be involved in the alleged offence.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has

Arshad Ahmed, who is director of Bihar Awami Co-operative Bank Ltd. and Mother International Academy. On his instance, those accounts were opened. The petitioner is staff of the Mother International Academy and only allegation against him is to fill up the account opening forms in the name of employees of the said Academy. It is further submitted that other co-accused Arun Kumar has already been granted bail by a co-ordinate Bench of this Court vide order dated 6.4.2023 passed in Cr. Misc. No. 43437 of 2022 upon whom the similar allegation has been made, hence, the case of this petitioner stands on similar footing of that of the coaccused. A statement has been made in para-3 of the petition that the petitioner has got no criminal antecedent. Moreover, the petitioner is languishing in judicial custody since 19.7.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail.
