The petitioner apprehends his arrest in Town P.S. Case No. 218 of 2014 registered under section 307 and other allied sections of the Indian Penal Code and 27 of the Arms Act. The informant alleged that while he along with his nephew Lala @ Rajnish were on a motorcycle, Shambu Prasad and his son Rohit Kumar came and made indiscriminate firing on Amit Kumar Gupta . The informant named Manoj Kumar Madan Prasad brother-in-law of Shambu Prasad and Rajesh Ram and alleged that they fled away. The informant further alleged that Vijay Kumar @ Mantu Kumar @ Mintu and Sunil Kumar @ Vicky were doing the work of liner along with
Patna High Court Cr.Misc. No.34943 of 2014 (2) dt.17-03-2015 2/2 petitioner but there is no sorts of allegation against the petitioner that he helped the accused persons in killing Amit Kumar Gupta. It is further submitted that Vijay Kumar @ mantu Kumar @ Mantu and Sunil Kumar @ Vicky have already been granted anticipatory bail vide Cri. Misc. No. 5202 of 2015. Considering the aforesaid facts, the above named petitioner in the event of his arrest or surrender in the court below within a period of four weeks from today is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in Town P.S. Case no. 218 of 2014, subject to the conditions as laid down under section 438(2) Cr.P.C.
