The petitioner seeks regular bail in connection with Aurangabad (Town) P.S. Case No. 138 of 2016 registered for the offences punishable under Sections 363, 368 and 372 of the Indian Penal Code.

The petitioner is in custody since 13.05.2016 in connection with Aurangabad (Town) P.S. No. 138 of 2016 pending in the court of CJM, Aurangabad. The petitioner is named in the F.I.R. with specific allegation that he with the help of other co-accused kidnapped the minor daughter of the informant with intention to sell her. The informant has alleged that this petitioner and other co-accused are indulged in trafficking of innocent girl for the purpose of selling. The

Patna High Court Cr.Misc. No.31574 of 2017 (2) dt.12-07-2017 learned Sessions Judge in order dated 16.09.2016 has stated that a large number of witnesses have supported the allegation of kidnapping of victim. This petitioner is main accused and his bail prayer has been rejected earlier by this court on 14.12.2016 in Criminal Miscellaneous No. 53792 of 2016. Nothing fresh material has come on record for considering the bail afresh except that he remained in custody for more than one year. Considering specific allegation of kidnapping against the petitioner, I am not inclined to reconsider his prayer of bail. The prayer of bail is accordingly rejected. (Sanjay Kumar, J) ajaypd./- U T
