Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with Barachatti P.S. Case No. 171/2021 registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.

There are specific allegations of torture and demand of dowry against the petitioner No. 1 and Petitioner No. 2 who

Patna High Court CR. MISC. No.65641 of 2021(2) dt.21-03-2022 2/2 are the father-in-law and mother-in-law of the deceased, their prayer for grant of anticipatory bail is rejected. So far as petitioner No. 3 is concerned, he is brother of the husband of the deceased (Dewar) and considering the status and allegations against him, his prayer for grant of anticipatory bail is allowed.

Accordingly, let the petitioner No. 3 Upendra Kumar be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati at Gaya, in connection with Barachatti P.S. Case No. 171/2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
