JUSTICE RAJIV ROY ORAL ORDER 04-09-2025 At the outset, learned counsel for the petitioner prays for and is allowed to implead the Deputy Collector, Land Reforms, Manjhaul, Begusarai in course of the day. 2.Heard Mr. Pramod Kumar, learned counsel for the petitioner and the Case.

3. The present petition has been preferred for the

Patna High Court CWJC No.14034 of 2025(2) dt.04-09-2025 2/3 following relief/s:

(i) for issuance of a writ in the nature of Mandamus or any other/direction to the respondent authorities to provide protection to his landed property/homestead land at his native village which is being encroached at the hand of local Mukhiya forming a group of local ruffians in collusion with the local Civil and Police administration.

The contention of the petitioner is that at the behest of the local Mukhiya Alok Kumar Bhartee of Gopalpur Gram Panchayat, Begusarai (respondent no.7), the State respondents are not acting despite passing an order vide memo no. 992 dated 30.05.2025 issued by the Circle Officer,Cheria Bariarpur, Begusarai (Annexure-P/5 to the petition).

4. Leaned State counsel submits that if a fresh petition alongwith the requisite fee is/are is filed, the State respondents shall be taking appropriate steps in the matter.

5. Learned counsel for the petitioner shall be filing a fresh representation alongiwth the requisite fee before the Revenue Authorities.

5. It is unfortunate that the Revenue Authorities do

6. If such petition is preferred in next four weeks, the Deputy Collector, Land Reforms, Manjhaul, Begusarai as also the Circle Officer, Cheria Bariarpur, Begusarai shall ensure that the parties are put on notice, date fixed and on the day, in the presence of all the persons interested in the present land, the measurement takes place, their signature obtained and copies served upon them.

7. Failure to do so, the petitioner shall be free to file contempt petition.

8. With the aforesaid observation, the writ petition is disposed of.
