Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Siwan Town P.S. Case No. 345 of 2022, lodged under Section 395 of the Indian Penal Code.

As per prosecution case, the F.I.R. has been lodged against 5 to 6 unknown persons who have alleged to be looted the bank, from its strong room, dacoity of Rs.22,44,116 took place. They have also looted the Mobile of Bank Cashier. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. The recovery was made from the possession of one Savindra Kumar @ Bhuwar from

Patna High Court CR. MISC. No.56189 of 2022(3) dt.15-02-2023 2/2 whose possession Rs.2,00,000/- have been recovered. Learned counsel for the petitioner further submits that petitioner is in custody since 09.07.2022, charge sheet has already been filed and antecedent of petitioner is clean.

Learned counsel for the State opposes the prayer for bail and submits that it is true that name of petitioner is not figured in this case but it is also true that looted Mobile has recovered from the possession of petitioner.

In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner, therefore, his bail application is hereby rejected. (Dr. Anshuman, J.) ritik/- U T
