JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-11-2019 The petitioner seeks regular bail in connection with Sessions Trial No. 314/2018 arising out of Dhansoi P.S. Case No. 66 of 2018, registered for offences punishable under Sections 302/34 of the Indian Penal Code.

Petitioner happens to be husband of the deceased and allegation against him is of causing death of the deceased by pressing her neck.

It has been submitted on behalf of the petitioner he has falsely been implicated in this case and there is no eye witness of the occurrence and other accused persons have already been enlarged on bail and petitioner has been in judicial custody since 04.07.2018.

Learned counsel for the State opposed the prayer for

Patna High Court CR. MISC. No.51364 of 2019(3) dt.16-11-2019 2/2 bail on the ground that the dead body of the deceased was found in the house of the petitioner. Moreover, there are altogether four injuries on the dead body of the deceased and no explanation has been given for that.

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail.

This application is accordingly, dismissed.
