The petitioners seek anticipatory bail in a police case registered under Sections 353, 147, 149, 224, 201, 413 and 414 of the Indian Penal Code.
The allegation against the petitioners is that when the police party during the investigation of another case regarding a stolen motorcycle had arrested the grand son (Sonu Kumar Dubey) of petitioner No.1 and brother of petitioner Nos. 2 and 3, in the process of seizure of the said motorcycle, the petitioners instigated the students of the coaching centre which they were running, as a result of which obstruction was put in the discharging of duty by
Patna High Court Cr.Misc. No.33829 of 2014 (2) dt.04-02-2015 the police officials and taking advantage of the same, Sonu Kumar Dubey escaped .
On a consideration of the facts and circumstances of the case and the nature of allegation, the prayer for anticipatory bail of the petitioners is rejected.
However, the petitioners may surrender in the court below and pray for bail, which shall be considered on its own merit. (Ramesh Kumar Datta, J) V.P.Sinha/- U
