The petitioner has preferred this application for grant of regular bail in a case registered under sections 304B, 201 and 34 of the Indian Penal Code.

As per the prosecution case, the daughter of the informant who was married to the son of the petitioner herein was tortured by all the accused persons including the petitioner for non-fulfillment of the demand of dowry by way of a bullet motorcycle. It is further stated that she was physically and mentally tortured, ultimately done to death and her body disposed off.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case because of being the mother-in-law of the deceased. There are

Patna High Court CR. MISC. No.65497 of 2021(2) dt.22-04-2022 2/2 no eye-witness to the alleged occurrence. The allegations are general and omnibus in nature. The husband of the deceased is in custody. The petitioner is in custody since 14.7.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the allegations being general and omnibus against the petitioner who happens to be the mother-inlaw of the deceased, the husband of the deceased being in custody, the petitioner having remained in custody for more than 8 months and charge sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Patahi P.S. Case no. 119 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran.
