JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-10-2017 The petitioner seeks regular bail in connection with Pachrukhi P.S. Case No. 177 of 2016, registered for offences punishable under Sections 302, 120B/34 of Indian Penal Code. Petitioner is husband of the deceased and allegation against him is of causing death of the deceased. It has been submitted on behalf of the petitioner that whole family members have been made accused in this case and they have been taken into custody soon after the occurrence and did not get the chance to explain about the death of the deceased. Further he has been judicial custody since 22.11.2016. Learned counsel for the State opposed the prayer for bail and submitted that death of the deceased was caused in the house of the petitioner.
Patna High Court Cr.Misc. No.46800 of 2017 (3) dt.11-10-2017 Having heard both sides, considering the fact and circumstances of the case and serious nature of allegation, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
