JUSTICE SUDHIR SINGH ORAL ORDER 25-04-2016 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners are apprehending their arrest in connection with Gogri P.S. Case No. 302 of 2015 for the offences instituted under Sections 363 and 366A/34 of the Indian Penal Code.
Crux of the prosecution case is that on 11.11.2015 at 11 A.M. the daughter of the informant Sajani Devi had gone to market to bring idol of lord Ganesh and did not return. Then the informant made hectic search and in course of search, she came to know that co-accused Ashutosh Kumar Thakur alias Balajee has enticed away her daughter. The informant enquired from the
family members of the said co-accused Ashutosh Kumar was not at home and the informant has shown definite suspicion that that the petitioners are instrumental in elopement of her daughter under conspiracy.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. The main allegation is against co-accused Ashutosh Kumar Thakur alias Balajee who is said to have eloped the victim girl. Petitioner no.1 is Bhabhi, petitioner no.2 is the sister, petitioner no.3 is the mother and petitioner no.4 is the father of said co-accused Ashutosh Kumar Thakur alias Balajee. There is no specific allegation against these petitioners.
On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Gogri P.S. Case No. 302 of 2015 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Brajesh Kumar, Judicial Magistrate, Ist Class, Khagaria, subject to the conditions as laid down under Section
438(2) of the Code of Criminal Procedure.
