The petitioner seeks bail in connection with S. Tr. No. 567/2017, arising out of Chiksaura P.S. Case No. 7 of 2017 dated 19.01.2017 instituted for the offences under Sections 364, 120B and 34 of the Indian Penal Code.
The son of the informant, viz. Sanjeev Kumar, was kidnapped and killed for his having developed liaison with one Priyanka Devi. The father of the deceased has lodged the F.I.R. alleging that the relationship between Priyanka and the deceased was known to the petitioner and others and because of this, the deceased has been done to death. The petitioner is the father of the aforesaid Priyanka. One of the co-accused persons, viz. Vijendra
Patna High Court Cr.Misc. No.47455 of 2017 (5) dt.02-01-2018 Paswan, who is the husband of the aforesaid Priyanka, has given his confessional statement before the police. Aforesaid Vijendra Paswan has been granted bail by a Bench of this Court. The petitioner is in custody since 27.05.2017 and does not bear any criminal antecedent.
Taking into account the facts that there is no material in the investigation papers except the confession of one coaccused, who has been granted bail, this Court is inclined to grant bail to the petitioner.
The petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with S. Tr. No. 567/2017, arising out of Chiksaura P.S. Case No. 7/2017.
