The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,307,504/34 and 379 of the IPC.

The prosecution case is that on the alleged date of occurrence, i.e., on 27.3.2018 at 8.00 A.M. in the background of dispute with regard to fixing the cattle shed, the informant and her son were assaulted. It is specifically alleged that Petitioner No. 2, Ambika Singh assaulted the son of the informant with Gahdal. It is also alleged that the gold chain of the informant was snatched.

It is submitted by learned counsel for the petitioners that in the background of land dispute, the accusation has been levelled.

The petitioners' side have also received injury and the injuries of both sides have been found to be simple in nature. The petitioners are accused in one other case of petty nature. It is further submitted that petitioner no. 1 is 70 years of age and petitioner nos. 2 and 3 are sons of petitioner no. 1. Considering the genesis of occurrence, the nature of injury being caused to the informant side and the petitioners' side have also received injuries, coupled with the counter version of the occurrence, let the petitioners above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM, Bikramganj, Rohtas in connection with Suryapura P.S. Case No. 33 of 2018 subject to the conditions laid down in Section 438(2) of the Cr.P.C.
