JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-08-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 74 of 2018, disclosing offences under Sections 498A, 323, 380, 354B of IPC and Section 3⁄4 of Dowry Prohibition Act.

Prosecution case as per the complaint petition is that complainant was subjected to cruelty and torture with respect to demand of Rs. 2,00,000/-.

Submission of the learned counsel for the petitioner is that earlier petitioner has lodged a case against the cousin brother of the complainant of kidnapping, for which, the complainant has appeared and she has stated that she had gone to cousin sister's house, as she was suffering from Tumor in her

Patna High Court CR. MISC. No.53269 of 2019(2) dt.26-08-2019 2/2 Uterus, for which, she was operated upon. Thereafter, the present case has been lodged after two months of lodging of the F.I.R. by the petitioner.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned S.D.J.M., Nawada, in connection with Complaint Case No. 74 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
