The petitioner is apprehending his arrest in connection with Allauli P.S. Case No. 251 of 2015 for the offences instituted under Sections 412 and 414/34 of the Indian Penal Code. As per prosecution case, the informant received confidential information with regard to unloading of looted iron rod from truck near Annu Trading and arrested one co-accused Deepak Roy who disclosed that the iron rod of Kamdhenu company loaded on looted truck was meant for sale to Annu trading.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. Petitioner has been

Patna High Court Cr.Misc. No.11267 of 2016 (2) dt.25-04-2016 named in the present case merely on the basis of confession of a co-accused Deepak Roy. Except for that, there is no other incriminating material against the petitioner. The other co-accused has already been granted anticipatory bail by this Court vide Cr.Misc.No.4435 of 2016.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Alauli P.S. Case No. 251 of 2015 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Tarun Kumar Jha, Judicial Magistrate, Ist Class, Khagaria, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
