This application is for grant of regular bail in connection with Naubatpur P.S.Case No.687 of 2015, registered for the offences under Sections 302/34 of the Indian Penal Code. From perusal of the F.I.R., it appears that there is direct allegation against the petitioner of causing death of one of the deceased.
It is submitted on behalf of the petitioner that the petitioner was not present at the time of occurrence but his alibi has not been considered by the Investigating Officer and further submission is that the confessional statement of the co-accused persons shows that they had fired and not the petitioner. The petitioner is in custody since 21.7.2016.
Patna High Court Cr.Misc. No.19938 of 2017 (5) dt.07-07-2017 Heard learned A.P.P. as well as the learned counsel for the informant. They have opposed the prayer for bail. Having heard both sides and in view of allegation of firing on the petitioner causing death of one of the deceased, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial of the petitioner. With the aforesaid observation, this application is dismissed.
