1. Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in connection with Jandaha P.S. Case No. 184 of 2022 registered for the offences punishable under Sections 323, 504, 506, 307, 341, 498(A) and 34 of the Indian Penal Code.
3. The petitioner and the informant, in compliance of the order dated 17.07.2023, are present physically in the Court.
4. The petitioner, at the outset, submits that he is willing to revive his conjugal relationship and will keep the informant with honour and dignity and will also ensure her wellbeing. It is further submitted that from perusal of the allegations
Patna High Court CR. MISC. No.55249 of 2022(7) dt.03-08-2023 2/2 as alleged in the FIR it would manifest that the allegations in sum and substance exist in every household which is known as normal wear and tear of life.
5. The informant, who is present in the Court, despite making all endeavors, is not willing to accompany the petitioner for reviving her conjugal relationship nor she has any serious grievance against the petitioner but still is not willing to accompany him.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Jandaha P.S. Case No. 184 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
