2. The petitioner has moved the Court under Section 482 of the Code of Criminal Procedure, 1973 for the following relief:

"That the present application is for quashing the order dated 21.10.2014 passed by Sri Amit Kumar Dixit, the learned Judicial Magistrate 1st Class, Muzaffarpur in Complaint Case no. 534/2014 corresponding to Trial No.

5355/14 whereby the learned Judicial Magistrate without proper going through the facts passed the said order for the issuance of Summon against the petitioner and one another."

3. At the very outset, learned counsel for the petitioner

Patna High Court CR. MISC. No.33808 of 2015(9) dt.05-04-2019 2/2 submitted that he may be permitted to withdraw the application.

4. Learned A.P.P. for the State is present.
