JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-03-2016 Petitioners being mother and sister of the husband of the informant are apprehending their arrest in a case registered for the offences punishable under Sections 498A/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

The basic accusation is of torture for nonfulfilment of dowry demand. It is submitted by learned counsel for the petitioners that petitioners admit the marriage of the informant with Deepak Kumar Mandal who is ready to keep the informant with full dignity and honour. A statement to that effect has been made in para 13 of the petition which reads as follows:- "That the husband of the informant namely Deepak Kumar Mandal is in jail

Patna High Court Cr.Misc. No.11322 of 2016 (2) dt.08-03-2016 2/2 and he is ready to live and keep the informant with her full respect and honour"

Considering the fact that thrust of accusation is against the husband of the informant, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 717 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
